No, it's not illegal. This happens all the time, but in most cases they do have sex, and no one really cares, because when you get past the ridiculous pedohysteria of the "ignorant masses" and down to an individual level, people realize there's nothing wrong with it. Of course all you ever see on the news are the handful of cases where the underage party or their parents decide they don't like it and get the older party arrested.

It's not illegal unless the girl objects (or if her parents are real bitches).
Also even if somebody presses charges because you are "abusing" a minor you won't get charged since most courts are intelligent enough to realize if you are in a relationship or if you are abusing her.

Actually if you follow it down, any "inappropriate touching" can be considered molestation, a bought off enough judge can stick you in jail and give you a record for kissing a 17 years 364 1/2 day old girl.
On the other hand, if the relationship seems genuine and no obvious sexual contact has happened beyond hugging and kissing usually judges overlook a few years on either side of the barrier but the rule of thumb is, if her parents would be mad and she's underage don't get caught!

In the U.S., if you are an "adult", it is VERY risky to have sex with a minor. If you are caught, you are in big trouble, whether the girl is 5 or 15. If she's 17, you might not get jailed, but you will still have to be a registered sex offender…
