Any sex when you have HIV is illegal if you don't tell them. If you do tell them and they choose to proceed then sex with or without a condom is legal.

It's not illegal, per se, there's no specific law against have sex if you have AIDS, regardless of your partner's knowledge about it.
I think you guys are confused because there have been civil suits against people who failed to inform their partners of their condition.
